SESSION TERMS AND CONDITIONS

PAYMENT METHODS – Lucid Photography accepts only cash, E-mail transfer, PayPal, debit and credit. Additional charge of 3% fee is applied for credit and PayPal use. Please note that cheques and bank drafts are not accepted.

DEPOSIT AND PAYMENT – Lucid Photography requires a deposit to finalize the booking of the coverage. If the deposit has not been paid, Lucid Photography is not to be expected to provide coverage. The deposit amount is calculated based on the package chosen. The deposit comes off the final price of the package (and it is not an extra charge).

The remaining balance of the complete package price plus GST (on the full amount) is due on session day. Lucid Photography will not create the online gallery for the client until the full balance has been paid. If a full payment is not made within 7 days from coverage date a late fee of $15 per day will apply until a full payment including the late fee is made. If the full payment is not made within 30 days from the coverage date the images from the coverage will be considered as abandoned and Lucid Photography will no longer keep them and takes no further liability in case of loss of images.

CANCELLATION, LATENESS, TIME SCHEDULE AND NO-SHOW– In case of session cancellation by the client, the deposit will not be refunded. Rescheduling of the coverage is at the discretion of Lucid Photography, on a case by case basis. In case of a no-show by the client, the deposit will not be refunded and if the coverage will be rescheduled a no show fee of $50 will apply to the new booking and a new deposit will be required.

Should the coverage start late due to the client being mildly late (up to 15 minutes), Lucid Photography will not reimburse the client for the lost time. While the full payment of the original coverage time will remain unchanged.

If the client is booked for a 15 minutes session and is late by 10 minutes or more to that session; the client will have to choose one of the following:

Upgrade to a 30 minutes (or longer) session package.

Forfeit service at which point the paid deposit is nonrefundable.

If the client is significantly late, 15 minutes or more, unless other arrangements have been made with Lucid Photography, Lucid Photography will consider the session as cancelled and will not be able to provide coverage. Moreover, the deposit will not be refunded and the coverage will not be rescheduled.

Session time starts no later than 10 minutes after client’s arrival. If the scheduled session can not be started within those 10 minutes (i.e. awaiting other members to arrive OR the client needs to get ready for the shoot) the time will be either taken from the scheduled session OR added as extra time.

In the highly unlikely case of the Photographer being late, Lucid Photography will make every effort to provide the clients with the full time of their chosen package by adjusting the end of the coverage accordingly. If for any reason, it is not possible to adjust the end of the coverage time the client may choose to one of the following

Downgrade their package to a different package that reflects best the coverage time

Get the remaining time left for the full coverage completed at the studio (on a different date and depending on availability)

LIMIT OF LIABILITY – In the unlikely event of severe medical, natural, or other emergencies beyond the control of Lucid Photography, Lucid Photography will make every effort to reschedule the session or secure a replacement if coverage is for an event and can not be rescheduled. If however, the coverage can not be rescheduled and/or a replacement can not be secured and Lucid Photography will be forced to cancel the coverage, the responsibility and liability of Lucid Photography is limited to the return of all payments received for the coverage up until that point.

In the unlikely and unforeseen case of a severe medical, natural, or other emergency that will force Lucid Photography to terminate coverage at any point during the coverage, the liability of Lucid Photography shall be limited to the closest package that represents a percentage of the covered time from the total amount of time scheduled for the coverage.

In the unlikely event that after the coverage the images from the coverage have been lost, stolen, or destroyed for reasons beyond the control of Lucid Photography, including but not limited to camera, hard drive, or equipment malfunction, Lucid Photography’s liability is limited to the return of all payments received for the coverage. In case of a partial loss of the original images, the liability of Lucid Photography shall be limited to a refund of the percentage of the lost digital images from the total number of the original digital images (captured during the coverage).

Lucid Photography is not liable for the loss of digital images or any other products at whatever comes first

The digital images and any other products have been provided to the client in any form including but not limited to a DVD, prints, flash drive (USB Stick) or a downloadable link.

The client has failed to pick up the digital images and any other products within 150 days from the coverage date.

During the photo shoot time Lucid Photography and any of its representatives make effort to provide the clients with a safe environment. However, Lucid Photography does not take the responsibility to guarantee the client’s wellbeing. It is the client’s responsibility to assess the safety of their parties’ actions. Careless actions such as running, horsing around, playing, touching of photography equipment and props are expected to be monitored by the clients. Lucid Photography is not responsible for wardrobe malfunctions. Hair and make up are clients responsibility and if those are not done properly Lucid Photography is not liable to fixing those issues in editing.

COPYRIGHT AND USE OF IMAGES- The images provided to the client by Lucid Photography are licensed solely for any reasonable personal use, including but not limited to printing, copying, E-mailing, personal websites and their use in social media (such as Facebook). Any images shared through social media must remain unaltered, including but not limited to cropping and any other editing. Additionally, any images shared through social media must include textual credit explicitly given to Lucid Photography.  Lucid photography reserves the right to use images from the session in their portfolio, on social media, websites and other promotional material.

In the case of copyright infringement Lucid Photography will contact the client and bring the matter to their attention. Moreover, Lucid Photography may revoke the license for personal use of the images that was initially provided to the client or the 3rd party.

Lucid Photography follows the Copyright Act of Canada and may use it to protect their work. Copyright Act (R.S.C., 1985, c. C-42) is located at – http://laws-lois.justice.gc.ca/PDF/C-42.pdf

SAFETY – Lucid Photography reserves to right to terminate coverage and leave the location of the coverage or in case of studio session to request the client to leave the studio, if a photographer from Lucid Photography experiences inappropriate, threatening, hostile or offensive behavior from person(s) during the coverage; or in the event that the safety of the photographer from Lucid Photography is in question.

DAMAGE TO EQUIPMENT – The client is responsible for any damage to any equipment caused by client’s direct action as well as any damage to any equipment caused by direct action of other participants that were invited by the client and were present during the coverage (such as family members, wedding guests and others). Any damage to any equipment as a result of client’s actions or their guests’ actions is to be repaired at the client’s expense; additionally the client will also be responsible for any loss of earnings whilst repairs are undertaken.

RESPONSIBILITIES – Lucid Photography is not responsible for compromised coverage due to causes beyond the control of Lucid Photography, including but not limited to, weather conditions, unforeseen scheduling complications, obtrusive guests, lateness of the clients or guests, incorrect addresses or directions provided to Lucid Photography, rendering of decorations, or restrictions of the locations. Lucid Photography is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the photo coverage. Lucid Photography is not responsible to fix in editing any wardrobe malfunctions, make up or hair issues. Lucid Photography is not liable to deliver every image taken at the event. The determination of images delivered to the client is left to the discretion of Lucid Photography. Criteria for images selection will be discussed during consultation.

SCHEDULING FOR DIGITAL IMAGES AND OTHER PRODUCTS – During coverage we shoot raw. Touched up images are images that have been extracted from the raw format. This type of editing includes but not limited to cropping, adjustment of white balance, colors, exposure, sharpness and other technical parameters that generally affect the image quality.

Fully edited images are images that have been further edited by applying local corrections, special filters and advanced imaging processing techniques which include but not limited to wrinkle removal, scar removal and other skin blemishes removal, body modifications (toning-up), teeth whitening and others. The final post production and editing styles, effects, and overall look of the images are left to the discretion of Lucid Photography.

The schedule for digital image processing and return to the client may be expedited for an extra fee. Otherwise the following schedule applies.

Lucid Photography is responsible to provide the clients with an online gallery to choose their images within 48 hours from the date remaining balance of the session was paid.

Lucid Photography is responsible to provide the clients with touched up images within 4 days since the clients have chosen their images. Lucid Photography is responsible to provide the clients with Fully Edited images within 3 weeks since the clients have chosen their images.

If the clients package includes prints, once the images are fully edited, the clients will need to choose the images for printing. The images for printing MUST be from their edited images. Once the clients provide Lucid Photography with their list for printing, the prints will be ready for pick up at Lucid Photography Studio within 2 weeks from that date.
